Of course, I find copyright law interesting in and of itself. Still, how these lawsuits get decided could have important implications for the freedom of information in the future. Not sure what copyright laws in Germany are like...

I think you are dead right Andy, publishers will at some point be begging Google to include them.
As a copyright owner with a book in Googles system I was more than happy to join in.
They are also beta testing sale of the book directly from the search ie. Google deliver the whole PDF rather than someone having to hop over to Amazon from the buy link
I can see how their 'opt-out' got people wound up , but in the long run it will be good for the book industry.
