I recently saw this question and have thought about it since then.
Any suggestions? Authority? I would highly appreciate opinions considering each contributor's jurisdiction.

It has been a while since I posted my question here. Unfortunately, no answer came in.
Well, the reason why I participate in this group is to gain, but also to share some knowledge.
Very recently, I stumbled upon some information with regard to tattoos and copyright that is accessible on NYT's website. While I acknowledge that it is not 100% related to the question I had previously posted here, I nevertheless believe that it provides for some insights on a subject not exhaustively clarified in either judiciary or academia.
Therefore, I decided to post the link to that article here on Xing, so anybody interested in the matter can access it.

In a nutshell:
Warner Bros may be restrained to show "The Hangover Part II", since a tattoo artist claims Warner Bros has infringed the copyright in a tattoo which the tattoo artist created.

In german law, I think, this is a case of §53 I 1 UrhG - also you should take notice of §58 UrhG in case of tattooing public images.

It is getting really exciting:
"Chief Judge Catherine D. Perry denied local tattoo artist S. Victor Whitmill’s motion for a preliminary injunction, thus ensuring that the film will have its start as scheduled Thursday evening." -
