I thought that colleagues from other countries - particularly those in Continental Europe and other civil law countries - might like to read the recent judgment of Mr Peter Prescott QC sitting as a deputy judge in our Patents Court in Oxonica Energy Ltd v Neuftec Ltd [2008] EWHC 2127 (Pat) (05 September 2008). As I am not sure that I have mentioned IP Newsflash before I'd like to thank our friend and moderator, Rolf Claessen, who appears to have provided this service. It is one of the gadgets on Blogger and I commend it to other bloggers, web masters and web mistresses.
I would be pleased to learn how other countries' courts would have construed a technology licensing agreement like the one in Oxonica. Am I right in thinking that the result would have been the same had it come before a court in France or Germany. What about the USA?
