Our Court of Appeal delivered a very interesting in judgment in Symbian Ltd v Comptroller General of Patents[2008] EWCA Civ 1066
http://www.bailii.org/ew/cases/EWCA/Civ/2008/1066.html) yesterday where it seems to have rowed back a little from its previous decision in Macrossan [2007] RPC 7, [2006] Info TLR 215, [2007] Bus LR 634, [2007] 1 All ER 225, [2006] EWCA Civ 137 (
http://www.bailii.org/ew/cases/EWCA/Civ/2006/1371.html) which had made it very difficult indeed to get a software patent in the UK. The CA seems to have made an effort to reconcile its jurisprudence with that of the EPO Technical Board of Appeal in Duns and Gameaccount.
