Dear all,
I am looking for law literature referring to the proper use of the symbols world wide. I am aware on the fact that the wrong use of such symbols can cause breach of unfair competition laws, etc. in some countries and the import and export of branded products can also lead to an incorrect use.
Nonetheless, the proper use of it might support trademark applications and the proof of use afterwards.
We are currently not using the symbols but consider the use of it and would like to know how others deal with this on a global scale.

Dear Andreas,
We use the R-symbol only when the trademark has definitely been registered. With this, we are on the safe side.

do you use the tm symbol at all?
Do you have any idea if it helps to use them for registration and proof of use?

I enclose an excerpt from INTERNATIONALES MARKENRECHT, Lesson 8, US Trademark Act, Managementcircle Verlag, 2nd Ed. 2008 which states
Registration Symbol - ® A benefit of obtaining federal registration is the right to use ®. Unregistered or common law marks may only use "TM".
SM - An abbreviation for a service mark and is used after a mark in superscript to designate common law rights in an unregistered mark -- SM.
....
TM - An abbreviation for a trademark and is used after a mark in superscript to designate common law rights in an unregistered mark -- TM.
Similar regulations apply mutatis mutandis in many countries of the former British Empire where these unregisterd Common Law Rights are referred to as TM or SM, respectively.
