    Transfer pricing documentation requirements in Slovakia with effect from 1 January 2009
    Dear All,

    With effect from 1 January 2009 the obligation to keep documentation on the transfer pricing method used by entities entering into transactions with foreign related parties was introduced in Slovakia.

    The details of requirements for such documentation were defined by the Slovak Ministry of Finance. Entities which must prepare their financial statements based on IFRS must maintain a full scope documentation, i.e. keep a masterfile and country specific documentation as outlined by the guidelines. Other related parties must maintian simplified documentation.

    Should in course of a tax audit the tax authorities request the company to provide them with the relevant transfer pricing documentation, the taxpayer must do so within 60 days of the request. The documentation must be submitted in the Slovak language, however, the tax authorities may approve its submission also in an other language.

    The obligation to keep transfer pricing documentation must be met for the first time for tax periods starting after 31 December 2008. For more details please refer to our tax alert on http://www.kpmg.sk.
