Dear group members,
I am interested in the inter-relation between sector-specific regulation and competition law enforcement in the telecoms sector. I would appreciate it If you are willing to share your impressions from the way those two regulatory regimes work in your countries. Maybe there are some noteworthy EU or national cases that you want to mention.
Are there some new developments regarding the refusal to supply in your jurisdictions?

Dear Milena,
I know about one case in Austria, which UTA Telekom AG, an alternative Telekomprovider indirectly won against the incumbent Telekom Austria. I was General Counsel of UTA Telekom AG at that time.
The case was briefly summarized as follows:
Telekom Austria asked for a tariff, which was approved by the National Austria Regulator RTR.
UTA claimed that this tariff allows Telekom Austria to misuse its dominant market position and therefore asked the Austrian Federal Competition Authority (Bundeswettbewerbsbehörde) to investigate this case. The line rental at that time included a 60 voice minutes free of charge. The argument was, that a competitive tariff (voice minutes) was cross subsidized by the monthly line rental (where Telekom has a market share of 97%).
The Federal Competition Authority brought the case against Telekom Austria before the Austrian Cartel Court and Telekom Austria finally lost this case an had to pay 500.000€ fines.
