I studied International Law in Vietnam and I think I can give you some information about the regulations in Vietnam.
After becoming member of the World Trade Organization (WTO) in 2006, many major multinational enterprises have conducted and planned to invest in Vietnam.
And the first proper transfer pricing regulations were introduced at the end of 2005 and came into force in 2006. At the present time, transfer pricing has become a hot issue in Vietnam and is being strongly focused on by the tax authorities, the Ministry of Finance of Vietnam released new transfer pricing regulations through Circular 66/2010 TT-BTC in 2010 . The new regulations introduced several changes, for example, the circular clarifies that the median value of an inter-quartile range will be used for benchmarking purposes, a number of significant technical amendments, including material differences thresholds.
The definition of related parties in Circular 66 is more extensive and broader than that of the OECD Model. Enterprises are deemed to be associated if one enterprise directly or indirectly holds at least 20% of the investment capital of the other enterprise, or one business establishment is the biggest shareholder directly or indirectly holding at least 10% of the shares or the total assets of the other. This regulation for being treated as associated parties is regarded as low compared with that in other country. For example the control threshold is 25% under Chinese transfer pricing regulations, and 50% under South Korean transfer pricing regulations.
