Acting as leading attorney for the lead contractor of the first BOT power plant and largest BOT project in Vietnam to date. This complex work centered around construction of the Phu My 720MW combined cycle power plant with an investment volume of approximately US$400 million. Work involved negotiating and drafting the required contract documentation and confronting significant, untested legal issues in relation to BOT projects in Vietnam. Foreign exchange and import issues, dispute resolution procedures and provisional acceptance mechanisms were all challenges in completing this important project. This work also involved reviewing a long- term maintenance contract; advising on construction and liability matters; preparation of a legal opinion regarding financing of Phu My 3.

Represent a German leading airport operator and manager in connection with stage 1 of its proposed involvement in the Long Thanh airport project planned for Ho Chi Minh City in Vietnam on a BOT (build-operate-transfer) basis (the “Project”). The total value of the Project is several billion U.S. dollars and will likely consist of three separate stages. Stage 1 is the negotiation and signing of a Memorandum of Understanding (“MOU”) with involved Vietnamese Government parties.
