The filing of intellectual property is usually associated with the payment of various fees. In terms of the service related to patent applications filed under the Patent Cooperation Treaty, the Japan Patent Office (JPO) has revised its fee schedule, which will come into effect from 1 April 2022. For an application in English, the additional fee payable to the JPO as an International Searching Authority has been increased from the current JPY 126,000 to JPY 168,000. The new additional fee payable to the JPO as the International Preliminary Examining Authority (IPEA) will be JPY 45,000 and the revised preliminary examination fee (IPEA/JP) will be JPY 69,000. In addition, the fees related to patents, trademarks, international search, utility models, designs etc., are also revised, which will come into effect from 1 April 2022. In Bezug auf den Service im Zusammenhang mit Patentanmeldungen, die gemäß dem Patent Cooperation Treaty eingereicht werden, hat das Japanische Patentamt (JPO) seine Gebührenordnung überarbeitet, die am 1. April 2022 in Kraft tritt. Für eine Anmeldung in englischer Sprache wurde die an das JPO als Internationale Recherchenbehörde zu zahlende zusätzliche Gebühr von derzeit 126.000 JPY auf 168.000 JPY erhöht. Die neue zusätzliche Gebühr, die an das JPO als internationale vorläufige Prüfungsbehörde (IPEA) zu entrichten ist, beträgt 45.000 JPY, und die geänderte vorläufige Prüfungsgebühr (IPEA/JP) beträgt 69.000 JPY. In T 2904/19 the Boards of Appeal of the EPO had to decide on the admissibility of an intervention and the re-ordering of requests. In the present case, an intervention of an assumed infringer was filed two days after oral proceedings before the Opposition Division were conducted. In the oral proceedings the patent was upheld as granted. Additionally, the opponent filed an appeal against the decision of the Opposition Division. In this case, the Board concluded that where an intervention is filed after the opposition division announced its decision and where a party to the opposition proceedings files an appeal, the notice of intervention will be deemed to be filed in appeal proceedings. Further, the Board found the re-ordering of two auxiliary requests of the patent proprietor admissible, since it could be shown that said re-ordering was not to the detriment of procedural economy and requested under exceptional circumstances, which have been justified with cogent reasons. Thus, although the hurdles for the admissibility of amendments according to the Rules of Procedure of the Boards of Appeal 2020 are high, they might be admissible under the above circumstances. ===== 🇩🇪 ===== In T 2904/19 hatten die Beschwerdekammern des EPA über die Zulässigkeit eines Beitritts und die Neuordnung der Anträge zu entscheiden. Im vorliegenden Fall wurde der Beitritt eines mutmaßlichen Patentverletzers zwei Tage nach der mündlichen Verhandlung vor der Einspruchsabteilung eingereicht. Im Rahmen der mündlichen Verhandlung wurde die Patentfähigkeit bestätigt. Außerdem legte der Einsprechende Beschwerde gegen die Entscheidung der Einspruchsabteilung ein. In diesem Fall kam die Kammer zu dem Schluss, dass die Streitverkündung als im Beschwerdeverfahren eingereicht gilt, wenn der Einspruch nach der Bekanntgabe der Entscheidung der Einspruchsabteilung eingereicht wird und ein am Einspruchsverfahren Beteiligter eine Beschwerde einlegt. Ferner hielt die Kammer die Umstellung zweier Hilfsanträge des Patentanmelders für zulässig, da nachgewiesen werden konnte, dass diese Umstellung nicht zu Lasten der Verfahrensökonomie ging und unter außergewöhnlichen Umständen, die stichhaltig begründet wurden, beantragt wurde. Description amendments: F-IV, 4.3 has been updated to soften the requirement of the adapted description to accord with the claims. No removal or prominent marking is necessary for embodiments in the description that are no longer covered by amended claims. 2. Establishing a technical effect of a simulation: G-II, 3.3.2 has been updated to clarify how to approach establishing if there is a technical effect of the claimed subject matter related to a simulation. 3. Partial priority considerations: F-VI, 1.5 has been updated to append a reminder to the discussion of situations involving partial priority: a later application cannot validly claim priority to a part of the application which already appears in the earlier application. 4. Inventors’ location: A-III, 5.3 has been updated to provide information how to state the adress of the inventor. We will provide detailed information in an upcoming post. ===== 🇩🇪 ===== Am 1. Teilprioritäten anzufügen: Eine spätere Anmeldung kann nicht wirksam die Priorität eines Teils der Anmeldung beanspruchen, der bereits in der früheren Anmeldung enthalten ist. 4. Wohnort des Erfinders: A-III, 5.3 wurde aktualisiert, um Informationen für die korrekte Angabe der Erfinder-Adresse bereitzustellen. In practice, this requires the patent applicant to demonstrate that the combined features produce a synergistic as opposed to mere additive effect. In the absence of an unexpected synergistic effect, combinations of known drugs for use in therapy are often considered obvious-to-try by the EP patent Examiners. As recent Boards of Appeal case law confirms, a claimed therapeutic combination must not have been the subject of accidental anticipation (T 2056/17), must show more than a mere additive technical effect, and must not have been "obvious-to-try" out of a number of possible alternatives (T 2168/17). ===== 🇩🇪 ===== Kombinierte Ansprüche haben in Europa immer eine hohe Patentierbarkeitsschwelle. In der Praxis bedeutet dies, dass der Patentanmelder nachweisen muss, dass die kombinierten Merkmale eine synergistische und nicht nur eine additive Wirkung haben. In Ermangelung eines unerwarteten synergistischen Effekts werden Kombinationen bekannter Arzneimittel zur Verwendung in der Therapie von den EP-Patentprüfern oft als naheliegend angesehen.
